Karnataka Factories Act (Amendment) 2023: The Karnataka Assembly has passed a bill to allow women to work in night shifts in factories. With the enactment of this law, the working women of Karnataka will get a lot of relief. Because of this bill, now women working in factories in Karnataka will be able to do duty even at night.
It also allows employees who work 12 hours a day for four consecutive days to take three days off in a week. The Karnataka Factories (Amendment) Bill was passed in the assembly without any debate. Law and Parliamentary Affairs Minister JC Madhuswamy said, “Working hours for women were limited and the government, including the software industry, was under pressure to relax it.”

So much so that the High Court had directed that under Article 14 of the Constitution all should be provided equal opportunity.” Earlier in 2020, the BJP state government had allowed women to work in night shifts in hotels, restaurants, cafes, theaters and other such shops and establishments.
Permission to work 48 hours a week
This bill allows the government to increase the daily working hours from 9 to 12, but not more than 48 hours in a week. It will generate more economic activities and employment opportunities. The minister said, “We are increasing the working hours to 12 hours a day. Those who work continuously for 12 hours for four days, which does not exceed 48 hours, can also take leave for three days in the bill. ” According to the bill, women can work between 7 pm to 6 am, but this is subject to a list of safeguards that need to be put in place by employers.
Women will get night shift cab
Looking at the safety of women in this bill, it has been clearly stated that it will be the duty of the employer or other responsible persons at the workplace to prevent the act of sexual harassment. In this bill, instructions have also been given to provide cab arrangements for bringing women employees in night shift and taking them back. Women employees should be employed in batches of at least 10.
CCTV footage will be saved
According to the bill, factories should have proper lighting and CCTV coverage, whose footage should be saved for at least 45 days. Employers must ensure that there are suitable working conditions for women and no employee should have reasonable grounds to believe that she is disadvantaged in relation to her employment. Now this bill will be presented in the Legislative Council.
